On August 30, 2014, Officer Brandon Schmitt was involved in a shooting incident where he fired multiple rounds at a vehicle driven by Joshua Peterson, who was suspected of burglary. Peterson was struck twice and subsequently became paraplegic. Peterson filed a federal lawsuit against Schmitt and the City of Minot, alleging excessive force, battery, and negligence. The shooting was investigated and deemed justified by the Burleigh County State’s Attorney’s Office, and Schmitt was cleared to return to duty. The lawsuit sought over $1 million in damages.
