In 2008, Officer Byron Russell was involved in the arrest of a motel owner who had complained about loud music. The plaintiff alleged that Russell used excessive force during the arrest, including pushing him into a glass door and handcuffing him without cause. The court found that the officers lacked arguable probable cause for the arrest and denied them qualified immunity on the excessive force claim.
