In the 2021 incident involving Mr. Reynolds, Officer Calhoun arrested Reynolds for disorderly conduct after Reynolds spoke in a raised tone late at night in a residential area. Reynolds alleged that this arrest was in retaliation for his exercise of protected speech. The court found that Calhoun had arguable probable cause to arrest Reynolds, which defeated the First Amendment retaliatory arrest claim, and thus, Calhoun was entitled to qualified immunity.
