In 2014, Officer Daugherty was involved in an incident where he allegedly used excessive force on M. McClendon, who was experiencing an epileptic seizure. Daugherty reportedly hit, kicked, and used a taser on McClendon, resulting in injuries such as a broken lip and lacerations. A lawsuit was filed against Daugherty and the City of Sumiton, alleging violations of constitutional rights. The court found that the allegations were sufficient to proceed with claims against Daugherty for excessive force and unlawful arrest.
