In 2001, Officer Duerksen was involved in the shooting of a woman who emerged from her residence holding a knife to her throat. After failing to comply with orders to drop the knife, Duerksen fired two rounds, striking her in the right thigh and as she was falling. The woman filed a lawsuit alleging excessive force, but the court granted summary judgment in favor of Duerksen, finding his use of force was objectively reasonable.
