Incident: Officer Eman Fondren, a four-year SAPD veteran, was caught in an embarrassing scandal of having sex on duty. In 2016, Fondren and a fellow officer carried out an ongoing sexual relationship while both were on the clock. The internal investigation began after Fondren’s then-wife provided 160 pages of explicit text messages between Fondren and Officer Rebecca Martinez (his patrol partner), describing their on-duty sexual encounters and even including explicit photos
. The two officers, who worked overnight East Patrol together, would disable their GPS locators to meet up and engage in sexual conduct instead of working, according to SAPD records.
Outcome: In April 2016, Chief McManus indefinitely suspended (fired) Eman Fondren for sexual misconduct and dereliction of duty
. Fondren appealed his firing through arbitration. In his case, the arbitrator ultimately upheld the termination, agreeing that the egregious breach of conduct warranted dismissal
. By 2018 it was confirmed that Fondren lost his bid to get his job back
. (He did not return to SAPD.) No criminal charges applied, but this case was significant as one of the rare instances where an arbitrator did not overturn an SAPD firing. Fondren’s wife also filed for divorce. The incident underscored the department’s intolerance for on-duty sexual activity, and McManus noted “certain things…we just can’t tolerate”

Officer Rebecca Martinez
Incident: Officer Rebecca Martinez (hired in 2010) was the other half of the 2016 on-duty sex scandal involving Officer Fondren. Martinez and Fondren exchanged explicit texts and met for sexual liaisons while patrolling, often disabling police equipment to avoid detection
. The affair, which took place during overnight shifts, was brought to light by Fondren’s wife’s complaint and evidence dump. Their actions violated multiple SAPD policies, including the strict prohibition on sex while on duty.
Outcome: Martinez was fired alongside Fondren in April 2016 after the Internal Affairs investigation substantiated the sexual misconduct allegations
. Like Fondren, she appealed her indefinite suspension. An arbitrator in her case also upheld the firing (March 2018 for Martinez’s case)
. Chief McManus expressed satisfaction that the firings stood, saying the arbitrator made the right decision
. Martinez did not regain her position at SAPD. (No criminal charges; this remained an internal matter. It’s noted that both officers’ peace officer licenses could have been at risk if they remained unemployed for too long, but at least as of 2018 neither was serving in SAPD.)
