On October 19, 2018, Officer Erik O’Brien shot and killed Jonathon Tubby in the sally port of the Brown County Jail. Tubby, who was unarmed, had maneuvered his handcuffs to the front of his body and refused to exit the squad car, leading officers to believe he was armed. Despite the absence of a weapon, Officer O’Brien fired eight shots, striking Tubby five times, including a fatal shot to the head. The District Attorney determined the shooting was justified, but Tubby’s family filed a federal wrongful death lawsuit alleging constitutional violations.
