    On April 1, 2020, Officer Gagne pursued and stopped an individual, Plaintiff, who was under the influence of alcohol and wearing a knee-high cast boot due to recent ankle surgery. Despite knowing Plaintiff’s home address and that he had arranged a ride, Gagne detained him, making statements such as ‘We can’t let you walk’ and ‘We’re going to make sure you’re safe.’ Plaintiff alleges these statements were made in bad faith, as Gagne had no probable cause to believe Plaintiff was committing a crime or posing a danger. Plaintiff was handcuffed, tackled to the ground, and placed in a police cruiser that could not accommodate his cast boot.
