In 1997, Officer John Beene was named interim chief following the termination of the previous Chief of Police. During his tenure, Officer Beene was involved in a series of incidents that led to allegations of creating a hostile work environment. Notably, he reassigned Officer Montgomery to a new supervisor, changed his work hours to a strict 8 a.m. start, and warned that non-compliance could result in termination. Additionally, after Officer Montgomery’s office was ransacked and personal belongings destroyed, Officer Beene allegedly took no action upon being informed. These actions contributed to a lawsuit filed by Officer Montgomery against the City of Ardmore, citing constructive discharge and violation of procedural due process. The case, Montgomery v. City of Ardmore, was reviewed by the Tenth Circuit Court in 2004.
