In May 2020, Officer Herd responded to a call involving 71-year-old Ray Beavers. After frisking Beavers and determining he was unarmed, Herd arrested him. Despite Beavers informing Herd of his recent rotator cuff surgery and inability to move his arm behind his back, Herd handcuffed him in that position, causing injury. Beavers filed a lawsuit against Officer Herd and the City of Oneonta, alleging unlawful seizure and use of excessive force.
