On February 27, 2002, Sergeant Ottie Cowgill responded to a shoplifting incident involving Christopher Lyons. During the arrest, Cowgill’s firearm discharged, injuring Lyons. The incident was deemed accidental, but Lyons filed a lawsuit alleging excessive force. The court found that a jury could conclude Cowgill’s actions were unreasonable under the circumstances.
