In 2017, Officer Richard Rush arrested Adrian Miranda for DUI. During the arrest, Miranda initially refused a blood draw but later consented. Despite this, Officer Rush proceeded to obtain a search warrant and reported Miranda’s refusal, leading to a 12-month suspension of Miranda’s driver’s license. Miranda contested the suspension, alleging that Officer Rush provided false testimony during the administrative hearing. A second hearing voided the suspension, and Miranda filed a lawsuit against Officer Rush and the City of Casa Grande, claiming violations of his due process rights. The court ultimately granted summary judgment in favor of the defendants, concluding that Miranda had not demonstrated a constitutional violation.
