In 1999, Correction Officer Salvatore Gemelli was accused of assaulting a mentally retarded inmate under his care. The County initiated disciplinary action more than 18 months after the alleged incident, which was contested due to the timing. An arbitrator found that the County failed to prove beyond a reasonable doubt that Gemelli committed the assault, leading to the vacatur of his dismissal.
