In January 2022, Sergeant Brandon Smart was involved in an off-duty incident at the Grandstand Casino in Billings. While off duty, Smart and other off-duty law enforcement officers confronted a driver who had yelled at them. The confrontation escalated, resulting in Smart being struck by the butt of a gun. An internal investigation concluded that Smart violated the agency’s policy on ethics and conduct. He received a formal reprimand, was stripped of all special duties for one year, and was required to undergo additional ethics and conduct training.
