    In January 2014, Sergeant Colby was involved in the detention of Brian Howarth, who exhibited severe medical symptoms. Despite being aware of discharge instructions indicating the need for immediate follow-up if symptoms worsened, Colby failed to ensure Howarth received necessary medical care. Howarth was later found unresponsive and died. A lawsuit alleged deliberate indifference to serious medical needs. The court found sufficient evidence to create issues of fact regarding Colby’s knowledge and inaction.
