In August 1999, Sheriff Donald Lolley removed Carl Eugene Rowe from a hospital against medical advice, placing him in the Choctaw County Jail without adequate medical care. Despite Rowe’s serious health conditions, including acute renal failure and pneumonia, Lolley denied him necessary medical attention, leading to Rowe’s death. This resulted in a lawsuit alleging deliberate indifference to serious medical needs, violating the Fourteenth Amendment. The court found that Lolley’s actions constituted a constitutional violation due to his deliberate indifference to Rowe’s medical needs.
