In 2015, Sheriff Kirk claimed to have smelled marijuana from a distance of 150 feet, leading to a search warrant and the discovery of 147 marijuana plants. The defendants argued that the search was based on false and intentionally misleading information. The charges were ultimately dismissed, and a lawsuit was filed against Sheriff Kirk and others for alleged constitutional violations and other claims.

Sheriff Kirk led a 2016 search of Joe and Linda Evans’ pawn shop, resulting in their arrests on drug and other charges. The charges against Joe Evans were dismissed, and Linda Evans’ charges resulted in a ‘no true bill’ from the grand jury. The Evanses filed a lawsuit against Sheriff Kirk and others, alleging violations of their constitutional rights.
