Sheriff Thomas was implicated in a case where excessive force was allegedly used against a pretrial detainee, Mr. Calhoun. The detainee claimed that Thomas and Deputy Wheeler applied force maliciously and sadistically, causing unnecessary pain and suffering. The court held that, if the detainee’s allegations were true, Thomas and Wheeler violated clearly established constitutional rights, regardless of whether the right was identified under the Fourth or Fourteenth Amendment. This case is documented in Calhoun v. Thomas, 360 F. Supp. 2d 1264.
