Officer Jordan was implicated in the wrongful convictions of Ralph Birch and Shawn Henning for a 1985 murder. It was alleged that Jordan failed to disclose exculpatory evidence, specifically an envelope containing $1,000 in cash found at the crime scene, which could have undermined the prosecution’s burglary theory. In 2019, after over thirty years of incarceration, Birch and Henning’s convictions were overturned. Subsequent lawsuits accused Jordan of violating their constitutional rights by withholding critical evidence. The district court denied Jordan’s motion for summary judgment, indicating that genuine disputes of material fact precluded his entitlement to qualified immunity.
