In 2001, a deputy from the Nevada County Sheriff’s Office was involved in an alleged excessive use of force against a prisoner who was reportedly not resisting at the time. The deputy was not entitled to qualified immunity against liability for the alleged excessive force. However, the sheriff’s purported condoning of the use of force by failing to immediately terminate the deputy occurred after the incident and therefore did not cause the deputy’s conduct.
