In December 2017, Officer Franklin Sears, a 21-year veteran of the Hot Springs Police Department, was terminated after failing a physical fitness and agility test five times. Sears appealed the termination, arguing that the department failed to follow its own policy requiring a fitness-for-duty evaluation by a physician before termination. In April 2020, the Arkansas Court of Appeals reversed the circuit court’s decision, finding that the department did not adhere to its policy. In August 2021, the city reached a $250,000 settlement with Sears, covering both his state and federal claims.
