James Chavez – Costilla County Sheriff’s Office

Sergeant James Chavez was accused in a 2010 lawsuit of using excessive force during the arrest of an individual named Deherrera. On March 3, 2009, Chavez allegedly slammed Deherrera’s head into a door, threw him to the ground, and applied pressure to his back while he was handcuffed. Deherrera claimed he complied with orders and did not resist arrest. The lawsuit included claims of excessive force under 42 U.S.C. § 1983 and state law claims for assault and battery.
