Former Sheriff James Klinicke faced charges of misapplication of entrusted property and public servant refusing to perform duty. Between May 19, 2008, and July 15, 2008, he seized equipment during a court-ordered property seizure but failed to turn it over to the creditor, instead keeping it in his squad car and later moving it to his garage. Additionally, he neglected to submit original copies of citations, applications for permits, and reports for several cases. He also failed to send a blood sample kit in a DUI case to the state toxicology lab, which was later found in his desk drawer. Klinicke resigned on November 26, 2008, and permanently surrendered his North Dakota peace officer’s license as part of an agreement that suspended the charges for two years, after which they would be dismissed if conditions were met.
