On July 20, 2019, Officer Gorny, while responding to a reckless driver call, drove approximately 90 mph and ran a red light, colliding with Erica Flores’ vehicle and causing her death. He intermittently used his lights and siren prior to the crash. A grand jury declined to indict him in August 2019. However, in September 2019, Police Chief Scott Ruszkowski recommended his termination, citing violations of several rules and conduct unbecoming of an officer. The Board of Public Safety fired Gorny in November 2019 after a two-day disciplinary hearing. The Flores family filed a federal wrongful death lawsuit alleging negligence by Gorny and inadequate training by the city.
