In 2004, Officer DiRago was stationed near the Masonic Temple during a party where a fatal shooting occurred. A lawsuit alleged that he failed to exercise reasonable care to control the conduct of third persons, leading to the death of Darnel Patrick Merritt. The court ultimately granted the defendants’ motion to strike the negligence claims, citing governmental immunity.
