In May 2021, Burke allegedly sexually assaulted the same victim at her home while in uniform and armed. Following an internal investigation, Burke pleaded guilty in August 2022 to three counts of insubordination and one count of discreditable conduct, resulting in a demotion from first-class senior constable to second-class constable for one year.
