In May 2020, while serving with the Roswell Police Department, Officer Delgado used excessive force by pulling a handcuffed woman out of a patrol car by her hair, throwing her to the ground, and placing his knee on her neck for over three minutes, resulting in a broken nose. This incident was reported to the New Mexico Law Enforcement Academy Board, which dismissed the case without reviewing video evidence. Delgado resigned and was subsequently hired by the Chaves County Sheriff’s Office. In June 2021, as a deputy, Delgado, along with Deputy Raul Ramos, shot and killed Oscar Najera, an unarmed man, during a response to a 911 call. The ACLU filed a lawsuit against the Chaves County Sheriff’s Office and the New Mexico Law Enforcement Academy Board, citing systemic failures leading to Najera’s death.
