Sergeant Elam – Boundary County Sheriff’s Office

In January 2014, Sergeant Elam was involved in the detention of Brian Howarth, who was experiencing severe medical issues. Despite observing Howarth’s deteriorating condition and being informed by a cellmate that Howarth needed hospital care, Elam failed to take appropriate action. Howarth was later found unresponsive and died. A lawsuit alleged deliberate indifference to serious medical needs. The court found sufficient evidence to create issues of fact regarding Elam’s knowledge and failure to act.
