In 2021, Sergeant Phillip Van Diepen was implicated in a case involving the alleged use of excessive force against Eric Virrueta. During the arrest, after Virrueta was taken to the ground by another officer, Sergeant Van Diepen deployed a taser on Virrueta, who claimed he was not resisting arrest at that time. This action was part of a lawsuit alleging violations of the Fourth Amendment. The court determined there were sufficient facts to support an excessive force claim against Sergeant Van Diepen.
