In 2010 and 2013, Officer Stoner, a veteran of active duty military deployments in Afghanistan and Iraq, applied for promotion to police corporal but was not selected. The Department of Justice alleged that his military service was a motivating factor in PCC’s decision to deny him promotion on both occasions. The former police chief, one of the selecting officials, demonstrated anti-military bias toward Stoner by making anti-military statements before and during the corporal selection process. In 2015, PCC settled the lawsuit by agreeing to provide Stoner with back pay and placing him in a regular police corporal position. Additionally, PCC amended its written personnel policies to advise employees of their rights and obligations under USERRA.
